Terms & Conditions of Enrolment
A binding agreement shall arise between you and the Australian College of Weight Management & Allied Health (ACWMAH) [ABN 16 605 382 956 | RTO 45052], which shall be governed by the laws of Australia, when you accept the Terms and Conditions by:
– Signing and returning the original copy of the Application of Enrolment Form, or:
– Ticking the box “I agree to the Terms and Conditions” within the online enrolment form, or:
– Making your first course payment, whether the payment is in full or a deposit on a payment plan.
Assurances and Code of Practice
Credibility and Governance
ACWMAH RTO 45052 delivers all Courses, Qualifications and Units of Competency Current and on Scope according to training.gov.au under our RTO registration by clicking here and are the issuing registered training organisation (RTO); they are approved and regulated by the Australian Skills Quality Authority.
ACWMAH implements policies and procedures which safeguard the interests and welfare of clients and stakeholders. These policies and procedures are detailed in the Student Handbook.

ACWMAH gives its assurance that staff involved in training & assessment have the relevant qualifications, skills and experience.
Student Recruitment & Support
In relation to the recruitment of students, ACWMAH will at all times be ethical and will comply with access and equity principles. ACWMAH has strategies in place to identify and support students with language, literacy and numeracy challenges and may, where required, refer the student to LLN specialist services in instances where client needs fall outside of the scope of ACWMAH (please note, any external support may attract an additional cost and is to be paid for by the student. ACWMAH does not pay for external costs incurred). Full details about Language, Literacy and Numeracy policy can be obtained from the Student Handbook.
Entry Requirements for the Nutrition for Personal Trainers (short course).
Essential entry requirements;
– hold their SIS30321 Certificate III in Fitness and SIS40221 Certificate IV in Fitness
– have the ability to use computers, to email, send and write word documents and to use – basic spreadsheets; and
have access to the internet.
Please be advised: This is not a nationally Recognised Training Product however is made up of Units of Competency from a Nationally Recognised Training Product and upon successful completion you will be issued with a Statement of Attainment towards 10859NAT Certificate IV in Weight Management
Entry Requirements for the 10859NAT Certificate IV in Weight Management and HLT37315 Certificate III in Health Administration.
Essential entry requirements;
– have the ability to use computers, to email, send and write word documents and to use basic spreadsheets; and
– have access to the internet.
Entry Requirements for the 10698NAT / 11133NAT Diploma of Weight Management
Essential entry requirements; entrants to the qualification must:
– hold the 10576NAT/10859NAT Certificate IV in Weight Management (or its successor), or a qualification at least at AQF level 4 in a relevant field such as fitness or allied health; and
– have the ability to use computers, to email, send and write word documents and to use basic spreadsheets; and
– have access to the internet.
Recommended entry requirements; the following criteria may facilitate successful completion of the course.
– all entrants – high level language, literacy and numeracy levels – sufficient to interpret research documents and medical or allied health practitioner referrals, liaise effectively with a range of healthcare professionals, prepare written reports (including referrals) and prepare a weight management plan including numeracy requirements for weights, measures and times.
Fees and Charges
ACWMAH will identify clearly for students the costs and terms of payment related to enrolment prior to students enrolling, this includes;
– Students enrolled into a Nationally Accredited Course have a 7-day orientation period from the date of enrolment.
– Students who withdraw within the 7-day orientation period will receive a full refund, less a $250 withdrawal fee; if the deposit paid was less than the $250 withdrawal fee, the balance will be due and payable at the time of withdrawal.
– Withdrawals will not be granted after the orientation period.
– Students are liable for the total course fees advertised and agreed upon at the time of enrolment, future promotions cannot be applied.
Students are responsible for honouring their course payments for the term of their finance agreement.
Payment Gateways
– Stripe Customers (enrolled since Nov 2022) – Failed payments on a payment plan will incur a $10 dishonour fee, failed payments will be re-tried 8 times over a 2 week period or manually on any given day and additional failed retries will not incur further dishonour fees, dishonour fees will be invoiced at the 3rd and 7th accumulated arrears and will be manually retried at the time they are generated.
– Ezypay Customers (enrolled Sept 2021-Nov 2022) – Failed payments on a payment plan will incur a $9.79 dishonour fee when re-debited, failed payments will be re-tried once a week and on every failed retry this will also incur a $9.79 dishonour fee. Please Note: Load Fees $2.20, Transactions Fees $1.10 and Dishonour Fees $9.79 are collected directly by the Payment Gateway (EzyPay Pty Ltd).
– eWay Customers (enrolled prior to Sept 2021) – Failed payments on a payment plan will incur a $10 dishonour fee when re-debited, failed payments will be re-tried every business day and additional failed retries will not incur further dishonour fees.
Default Proceedings
Any student entering into a finance agreement who falls into arrears of $400 will be considered to be in breach of their finance agreement and will therefore be required to pay the outstanding arrears in full within 7 days. Failure to do so will result in your default information (as permitted under the Privacy Act and other relevant Laws) being provided to a Default Reporting Agency to list the default debt (balance of your course fees plus an additional $100 Administration Fee for default listing) against your credit file.
In cases where students are suffering from medical ailment and are able to provide adequate documentation of such, upon application in writing, the student’s enrolment may be suspended for a period of no more than 6 months. No refund of course fees apply and the student will still be liable for all payments due under the agreed payment plan (if applicable).
Additional Fees
Students enrolled in HLT33015 Certificate III in Allied Health Assistance and/or HLT43015 Certificate IV in Allied Health Assistance may incur additional costs applicable to the Vocational Placement requirements such as appropriate workwear or uniform and a National Police Check prior to undertaking the first day of placement.
Students that require additional time to complete studies may incur additional costs, please refer to the Student Handbook regarding extensions.
Students may incur additional costs via external dispute resolution processes, costs are determined at the time ACWMAH is made aware and notification is provided to the student to confirm if they wish to proceed with such external processes and invited to resolve the matter internally as an alternative.
Students may incur additional costs associated with account keeping fees, should there be a change or increase the student will be notified and provided options to mitigate these additional costs.
Consent to Credit Check
If you are a company, please note that ACWMAH will perform a credit check.
If you are a natural person you:
2.1. understand that the Privacy Act allows us to give a Credit Reporting Agency certain personal information about you. The information we disclose to a Credit Reporting Agency includes permitted information which will allow you to be identified, the fact that you have applied for credit and the amount, the fact that we are a current credit provider to you, repayments that are overdue and for which debt collection action has started, information that in our opinion you have committed a serious credit infringement (i.e. acted fraudulently or shown an intention not to comply with your credit obligations);
2.2. agree to our obtaining from a Credit Reporting Agency a credit report containing information about your personal credit worthiness for the purpose of assessing your application and for the purpose of assisting in collecting overdue payments; and agree to our obtaining about your commercial activities or commercial creditworthiness from any business which provides information about the commercial credit worthiness of persons, your accountant or any other supplier to you;
Agree to our giving to and obtaining from any credit provider named in your Application or in a credit report on you issued by a Credit
Reporting Agency, information about your credit arrangements for the purposes of:
3.1. assessing your Application;
3.2. notifying a default by you;
3.3. allowing another credit provider to ascertain the status of your arrangements with us where you are in default with one or more other credit providers; and
3.4. generally assessing your credit worthiness.
You understand the information exchanged can include any information about your personal and/or commercial credit worthiness, credit standing, credit history or credit capacity which the Privacy Act allows credit providers to give to or receive from each other.
Disclaimer
Every attempt is made to ensure all information from the Australian College of Weight Management & Allied Health is accurate and that the student has attained the competencies taught in a course, at the point of their assessment. Beyond this point, the graduate is responsible to maintain their acquired competencies, and apply acquired knowledge and skills in a way which is appropriate to the unique characteristics of each application. This will release the Australian College of Weight Management & Allied Health from any liability, action and claims of whatsoever nature in connection with, or arising from any such information instruction or advice, given by any student or ex-student, whether directions given during the course are followed or not. Privacy Notice
Why we collect your personal information
As a registered training organisation (RTO), we collect your personal information so we can process and manage your enrolment in a vocational education and training (VET) course with us.
How we use your personal information
We use your personal information to enable us to deliver VET courses to you, and otherwise, as needed, to comply with our obligations as an RTO.
How we disclose your personal information
We are required by law (under the National Vocational Education and Training Regulator Act 2011 (Cth) (NVETR Act)) to disclose the personal information we collect about you to the National VET Data Collection kept by the National Centre for Vocational Education Research Ltd (NCVER). The NCVER is responsible for collecting, managing, analysing and communicating research and statistics about the Australian VET sector.
We are also authorised by law (under the NVETR Act) to disclose your personal information to the relevant state or territory training authority.
How the NCVER and other bodies handle your personal information
The NCVER will collect, hold, use and disclose your personal information in accordance with the law, including the Privacy Act 1988 (Cth) (Privacy Act) and the NVETR Act. Your personal information may be used and disclosed by NCVER for purposes that include populating authenticated VET transcripts; administration of VET; facilitation of statistics and research relating to education, including surveys and data linkage; and understanding the VET market.
The NCVER is authorised to disclose information to the Australian Government Department of Education, Skills and Employment (DESE), Commonwealth authorities, State and Territory authorities (other than registered training organisations) that deal with matters relating to VET and VET regulators for the purposes of those bodies, including to enable:
administration of VET, including program administration, regulation, monitoring and evaluation
facilitation of statistics and research relating to education, including surveys and data linkage
understanding how the VET market operates, for policy, workforce planning and consumer information.
The NCVER may also disclose personal information to persons engaged by NCVER to conduct research on NCVER’s behalf.
The NCVER does not intend to disclose your personal information to any overseas recipients.

Accepting Terms and Conditions for online enrolments:
– All information I have provided is true and correct
– I acknowledge that I have read and understand the Code of Practice on this enrolment form as well as the full Student Handbook and that I agree to abide by all ACWMAH policies, terms & conditions and am aware of my rights and obligations.
– I have read and agree to the timelines specified in the Student Handbook for the course/s I am enrolled in.
– I agree to pay the associated costs to extend the duration of the course/s I am enrolled in, if needed.
– I give permission to ACWMAH to use any marketing materials that refer to me.
– I (and/or the parent or guardian) understand that I (and/or the parent or guardian) am legally bound to honour the financial contract I (and/or the parent or guardian) am signing.
– I agree to the refund and cancellation policy.
– I give permission for ACWMAH to verify my USI.
– I hereby acknowledge and agree to all aspects of this enrolment and confirm this by ticking the box “I agree to the Terms and Conditions” within the online enrolment form .
Direct Debit Agreement
(Required)
I agree to the Direct Debit Agreement outlined below.
1. By agreeing to the Direct Debit Request you authorise Stripe to arrange for funds to be debited from your nominated financial institution account (the nominated account is the Debit/Credit Card used to make payment of your course deposit). Stripe is acting as an agent for Australian College of Weight Management Pty Ltd and Stripe does not provide any goods or services to you.
2. Stripe or Australian College of Weight Management Pty Ltd will give you at least 14 days notice in writing of any changes to the terms of the drawing arrangements.
3. Stripe will keep information relating to your nominated account confidential in accordance with Stripe’s privacy policy, except where required for the purposes of conducting direct debits with your financial institution. Your personal information will be transferred by Stripe to the United States. If you do not want to provide your personal information to Stripe in connection with the Direct Debit Request, Stripe will not be able to debit your nominated account.
4. Where the due date is not a business day Stripe will draw from your nominated financial institution account on the next business day.
5. It is your responsibility to:
– Ensure your nominated account can accept direct debits;
– Ensure that there are sufficient clear funds available in the nominated account to meet each drawing on the due date;
– Advise immediately if the nominated account is transferred or closed or your account details change;
– Arrange a suitable payment method if Stripe or Australian College of Weight Management Pty Ltd cancels the drawing arrangements;
– Ensure that all authorised signatories nominated on the financial institution account to be debited authorise the Direct Debit Request.
6. Subject to the terms and conditions of your nominated financial institution account and your agreement with Australian College of Weight Management Pty Ltd, you may alter the drawing arrangements. Such advice should be received by Australian College of Weight Management Pty Ltd at least 7 business days prior to the drawing date for any of the following:
– Changing your nominated account number
– Altering a DDR schedule
If you require further information, please contact Australian College of Weight Management Pty Ltd. Alternatively, you can also contact your financial institution or confirm your financial rights.
7. If you believe that there has been an error in debiting your account, you should notify Australian College of Weight Management Pty Ltd as soon as possible. Australian College of Weight Management Pty Ltd will notify you in writing of its determination and the amount of any adjustment that will be made to your nominated account (if any). Stripe will arrange for your financial institution to adjust your nominated account by the applicable amount (if any). Alternatively, you can also contact your financial institution.
8. The details of your drawing arrangement are contained in the Direct Debit Schedule below.
9. Stripe reserves the right to cancel the drawing arrangements if three consecutive drawings are dishonoured by your financial institution, and for Australian College of Weight Management Pty Ltd to arrange with you an alternative payment method. Please refer to the terms and conditions of your nominated financial institution account to see whether dishonour fees apply. Australian College of Weight Management Pty Ltd may charge additional dishonour fees in accordance with your agreement with Australian College of Weight Management Pty Ltd Terms of Enrolment.
